Criminal, civil and internal investigations
Investigations fall into three categories; criminal, civil and internal investigations, that are subject to employment law.
Each investigation however, will be undertaken in the same manner, with a process of client consultation, development of legal strategy and undertaking the appropriate and proportionate investigative steps.
At the conclusion of each investigation, a report will outline the processes used and evidence gathered. As part of the service, the expert will always be available for attendance at court or tribunal for the presentation of their evidence, which is of course open to scrutiny.
Corporate investigations are becoming more prevalent, in particular in relation to fraud and theft of intellectual property by employees seeking to set up rival business interests.
The investigation strategy for each case is developed with the following legislation in mind: Data Protection Act, Regulation of Investigatory Powers Act, Human Rights Act and several pieces of criminal legislation, such as the Police and Criminal Evidence Act.
In addition to the extensive legal and investigative knowledge held in-house by our team, we have developed relationships with several law firms which specialise in topics associated with IT investigations and evidence.
These lawyers are relied upon for specialist advice and indeed provide another avenue for new business.
We also review all recent cases and keep abreast of new case law and the emergence of new legislation in this rapidly changing legal environment.
