Computer misuse
The misuse of e-mail and the Internet in the workplace has rapidly become a serious issue for employers.
When faced with the prospect of an employment tribunal, or whether to discipline or dismiss an employee, accurate and admissible computer related evidence is vital.
A forensic process will ensure that an investigation gathers accurate information that can be relied upon should a case be contested and reach an employment tribunal.
It will also ensure impartiality towards the person under investigation and allow the employer to take decisions based upon sustainable information.
It is increasingly likely that IT staff will be asked to conduct an internal investigation that involves computer data.
Investigations need to be conducted fairly and in line with disciplinary procedures. It is therefore also essential that HR participate in this process.
In a recent case following the dismissal of an employee, an internal investigation had documented access by the employee to a particular site over 1000 times; however forensic investigation concluded the site had not been visited at all!
We can work with you to ensure that not only is your admissible, but that it is accurate.
